Separate from adult sex offender registration and notification laws, the federal Adam Walsh Child Protection Act (2006) created new lifetime registration and notification requirements for juveniles who are adjudicated in delinquency court for qualifying sexual conduct offenses. The federal Act “motivated” state statutory compliance through the possible penalty of losing ten percent of the state’s federal Edward Byrne Act justice assistance grant funds.

The federal Act “motivated” state statutory compliance through the possible penalty of losing ten percent of the state’s federal Edward Byrne Act justice assistance grant funds. Some states have refused to comply with the federal mandate while others have passed legislation requiring certain categories of juvenile offenders to meet lifetime registration and notification requirements upon adjudication for a qualifying offense.

This webinar will offer an update with regard to state compliance or noncompliance as administered by the federal SMART office which monitors the Adam Walsh Act. It will also discuss state legislative policy advocacy and strategies in opposition to state compliance legislation. This webinar will also consider state court litigation strategies at trial and on appeal that have been and are being employed to challenge the application of lifetime juvenile sex offender registration and notification laws. Where state law denies a juvenile in delinquency court the right to a jury trial, this webinar will also examine the pros and cons of seeking jury trials where the juvenile faces lifetime registration for a qualified sex offense.
